Welcome to IronTrac. These Terms of Service (“Terms”) govern your access to and use of the IronTrac website, mobile application, platform, and related services (collectively, the “Services”) provided by Entraca LLC d/b/a IronTrac (“IronTrac,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, and “you” includes that entity.
If you do not agree to these Terms, do not access or use the Services.
1. Eligibility and Authorized Use
You may use the Services only in compliance with these Terms and applicable law. You must be at least 18 years old and legally capable of entering into a binding agreement.
The Services are intended for business and operational use. You agree to use the Services only for legitimate internal business purposes and not for unlawful, fraudulent, harmful, or abusive purposes
2. Scope of Services
IronTrac provides software, a public website, a mobile application, operational tools, support resources, and related services designed to support asset tracking, inspections, certifications, field workflows, connected-device workflows, and related operational processes.
Certain Services may be subject to a separate proposal, order form, subscription agreement, master services agreement, or statement of work. If there is a conflict between these Terms and a separately executed commercial agreement, the commercial agreement will control to the extent of the conflict.
3. Accounts
To access certain features, you may be required to create or receive an account. You agree to provide accurate and complete information and keep it current.
You are responsible for safeguarding account credentials and for all activity occurring under your account. You must promptly notify us of any suspected unauthorized access, misuse, or security incident involving your account.
We may suspend or disable access where reasonably necessary to protect the Services, users, customer data, or IronTrac’s systems.
4. Mobile App License
Subject to these Terms, IronTrac grants you a limited, non-exclusive, non-transferable, revocable right to install and use the IronTrac mobile app on compatible devices that you own or control, solely for your internal business use in connection with the Services.
You may not rent, lease, sublicense, redistribute, modify, reverse engineer, decompile, or disassemble the mobile app except to the extent such restriction is prohibited by law.
You acknowledge that the availability of the mobile app may depend on third-party platforms and marketplaces, including Apple App Store and Google Play, and your use of those platforms is also governed by their applicable terms and policies.
5. Device Access, Bluetooth, GPS, and Permissions
Certain features of the Services, particularly within the mobile app, may require access to device capabilities or permissions, including Bluetooth, nearby devices, camera, photos, files, notifications, and GPS or other location-related permissions.
You acknowledge and agree that:
- some IronTrac functionality may require Bluetooth access to discover, pair with, connect to, communicate with, or exchange data with supported external hardware or peripherals;
- IronTrac may receive, process, display, or store data transmitted from connected devices, including connectivity information, device identifiers where applicable, and readings or measurements generated through supported workflows;
- some IronTrac functionality may independently use GPS or other location services to support field operations, location-aware workflows, mapping, record creation, audit trails, or related operational functions;
- some mobile operating systems may require additional permissions in connection with Bluetooth discovery, nearby-device communication, or location-enabled features;
- you may choose whether to grant most device permissions, but denying permissions may limit or disable certain features.
You are responsible for ensuring that any external device you connect to IronTrac is authorized for your use, properly maintained, and operated in accordance with manufacturer instructions and applicable law.
IronTrac is not responsible for failures, inaccuracies, downtime, or damage caused by third-party devices, hardware manufacturers, operating-system restrictions, wireless interference, battery conditions, signal limitations, environmental conditions, or other causes outside IronTrac’s reasonable control.
6. Acceptable Use
You will not, and will not permit any third party to:
- use the Services in violation of law or regulation;
- interfere with the integrity, performance, or security of the Services;
- attempt to gain unauthorized access to accounts, devices, systems, or networks;
- upload or transmit malicious code or harmful content;
- use the Services to build or support a competing service;
- scrape, copy, harvest, or extract data from the Services except as expressly authorized;
- misuse APIs, integrations, demo accounts, support channels, or Bluetooth, GPS, or device-connectivity features.
7. Customer Data
As between you and IronTrac, you retain ownership of the data, records, files, images, inspection information, GPS/location information captured within your workflows, device-transmitted information, readings, measurements, and other information submitted to the Services by you or your authorized users (“Customer Data”).
You grant IronTrac a limited right to host, process, transmit, display, store, and use Customer Data solely as necessary to provide, support, secure, maintain, and improve the Services, enforce our agreements, and comply with legal obligations.
You are responsible for the legality, accuracy, and integrity of Customer Data and for obtaining any permissions, notices, or consents needed for your use of the Services and any connected devices.
8. Third-Party Devices, Integrations, and Services
The Services may connect with third-party software, hardware, mobile operating systems, Bluetooth devices, scanners, gauges, sensors, GPS/location services, or other external services. IronTrac does not manufacture or control third-party devices or services and is not responsible for their performance, safety, availability, security, or accuracy.
The mobile app may also use third-party service providers for support functions such as crash reporting, diagnostics, analytics, hosting, authentication, communications, or notifications. Your use of the Services may therefore involve third-party infrastructure and SDKs that support IronTrac functionality.
Any third-party terms that apply to those products or services remain between you and the applicable third party.
9. Updates and Changes
IronTrac may release updates, patches, fixes, upgrades, or changes to the website, platform, or mobile app. Some updates may be required for continued functionality, security, compatibility, or connected-device support.
We may modify, suspend, or discontinue portions of the Services from time to time. We are not liable for changes required by operating systems, app marketplaces, device manufacturers, GPS/location providers, or third-party platforms.
10. Website Content and No Professional Advice
Content made available through the Services is provided for general informational and operational purposes only. It is not legal, tax, engineering, inspection, safety, or regulatory advice. You remain responsible for your own operational decisions, compliance obligations, and the use of any connected hardware, GPS/location-enabled workflows, or field processes.
11. Fees and Payment
Paid Services are governed by the applicable proposal, order form, or subscription agreement. Unless otherwise stated in a written commercial agreement, fees are non-refundable and payable in U.S. dollars.
12. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT AS EXPRESSLY STATED IN A SEPARATE WRITTEN AGREEMENT SIGNED BY IRONTRAC.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONTRAC DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
IRONTRAC DOES NOT WARRANT THAT THE SERVICES, MOBILE APP, GPS OR LOCATION FEATURES, OR ANY CONNECTED DEVICE COMMUNICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY DEVICE, PERIPHERAL, OPERATING SYSTEM VERSION, OR NETWORK CONDITION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONTRAC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONTRAC’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT PAID BY YOU TO IRONTRAC FOR THE APPLICABLE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU ONLY USE THE WEBSITE and have paid no fees, IRONTRAC’S TOTAL LIABILITY WILL NOT EXCEED $100.
14. Privacy
Your use of the Services is also subject to the IronTrac Privacy Policy, which describes how we collect, use, and disclose information, including information associated with the website, mobile app, crash reporting tools, connected devices, GPS/location features, and support interactions.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Venue shall lie in the state or federal courts in Texas, unless otherwise stated in a separate signed agreement.
